General Terms and Conditions Bad Zurzach Tourismus AG

1 ) Scope of application

1.1 These General Terms and Conditions govern the contractual relationship between customers who order or purchase services provided by Bad Zurzach Tourismus AG (hereinafter: BZT) itself, be it guided tours, its own events or the purchase of merchandising articles.

1.2 If BZT arranges services from other companies (hotel bookings, ordering tickets for events, room reservations, etc.), BZT is not a contractual partner and the contractual and travel conditions of the organizer apply.

2 ) Conditions for Bad Zurzach Tourismus AG’s own service offers

2.1 Guided tours

2.1.1 The following applies to the guided tours offered and conducted by BZT itself

2.1.2 Conclusion of contract: The contract between the customer and BZT is concluded with the formal acceptance of the written (letter, email or internet) or verbal order by BZT.

2.1.3 Services provided by BZT: BZT undertakes to provide the services described in the offer, subject to changes due to unforeseen circumstances for which BZT is not responsible.

2.1.4 Liability: BZT’s liability for non-performance or improper performance of services is limited to gross negligence or willful misconduct. The customer is responsible for the safe storage of valuables (cash, credit cards, jewelry, etc.) and BZT accepts no liability in the event of loss, theft, damage, etc.

2.1.5 Agreed times: The tour guide will not wait for late participants.

2.1.6 Cancellation: If a booked tour is canceled by the customer after the contract has been concluded (section 3.1), the following cancellation fees will be charged:
30 – 21 days before the tour 50%
21 – 3 days before the tour 75%
2 – 0 days before the tour 100 %
Failure to show up for a tour will be treated as a cancellation.

2.1.7 Terms of payment: Unless otherwise agreed, BZT accepts payment against invoice, cash and credit card transfer (Postcard, Mastercard, Visa, Maestro) in Swiss francs and euros.

2.2 Events

BZT regularly organizes events for which the following conditions apply: The participant is not insured by the organizer. The participant must have taken out adequate health and accident insurance (including sports accidents). Cancellation insurance is recommended. Despite expert and safe execution of the activities, accidents cannot be ruled out. The organizer cannot accept any liability for this. Participation is at your own risk.

2.3 Online store, other sale of vouchers, merchandise and trade items

2.3.1 The sale of vouchers, merchandise and trade items from BZT is governed exclusively by the provisions of the Swiss Code of Obligations on sales (Art. 184 et seq. CO).

2.3.2 Prices: All prices include the statutory value added tax. All prices are in CHF.

2.3.3 Price changes: Bad Zurzach Tourism may change or adjust the price list at any time. The agreed prices apply to items that have already been ordered.

2.3.4 Order: These General Terms and Conditions form an integral part of every purchase.

2.3.5 Delivery conditions: The shipping costs are CHF 3.40 for letters up to CHF 100 (A Mail Plus) and CHF 9 for Priority and CHF 7 for Economy parcels within Switzerland. From an order value of CHF 100, delivery is free of charge. There is no shipping abroad. Dispatch usually takes place within 1 – 2 working days of receipt of the order. If the ordered items are not in stock, we will inform you immediately.

2.3.6 Retention of title: The delivered goods remain the property of Bad Zurzach Tourismus until full payment has been received.

2.3.7 Method of payment: Items ordered online are payable by Visa, Master, Masterpass, PayPal, TWINT, PostFinance Card and PostFinance e-finance. Orders received by telephone must be paid for by invoice within 30 days.

2.3.8 Notification of defects: Notices of defects of any kind can only be considered if they are made in writing within 5 days of receipt of the goods.

2.3.9 Exchange: Ordered items can only be exchanged if they are in their original packaging. In addition, the items must not be used or damaged. Any postage costs incurred as a result of an exchange will be charged to the customer.

3) Arranging third-party services (in particular hotel and accommodation reservations, room reservations, seminars)

3.1 Where BZT arranges third-party services, the respective terms and conditions of the third-party partner shall apply.

3.2 Conclusion of contract: The contract between the customer and the third party is concluded analogous to section 3.1 above with the formal acceptance of the written (letter, e-mail or internet) or verbal order by BZT. BZT is not a party to the contract in these cases.

3.3 Liability/Complaints: BZT does not accept any liability for services that are merely arranged by BZT. Any complaints about the brokered service must be addressed exclusively and without delay to the third party.

3.4 Cancellation conditions: The cancellation conditions applicable to the procured service provider are listed individually for each inquiry or order and are binding for both contracting parties.

4) General provisions

4.1 Severability clause: Should any provision of these General Terms and Conditions be invalid in whole or in part, it shall be replaced by an equivalent provision which comes as close as possible to the economic value of the invalid provision. The validity of the remaining provisions is not affected by this.

4.2 Applicable law: The contract between the Customer and BZT, including the question of the conclusion of the contract, is subject exclusively to Swiss law.

4.3 Place of jurisdiction: The exclusive place of jurisdiction for any disputes between the customer and BZT is Bad Zurzach.
