d. when booking, ordering or making reservations with third parties

There are various options on our website for making bookings or reservations or requesting information material or other services. The corresponding services are provided by third parties. The evaluation is voluntary and anonymous and serves to ensure the quality of our products and services.

e. Competitions

Personal data (first name, surname, email address) is collected when participating in a competition offered on this website, newsletter or at events. By participating in the competition or the survey, the user gives his/her conclusive consent in accordance with Art. 6 para. 1 lit. a GDPR that his/her personal data entered will be stored by the operator and used to run the competition and to determine and notify the winners. By participating, the user agrees that their name will be published on this website and on the public social media channels of Bad Zurzach Tourismus AG (Facebook, Twitter, Instagram) if they win. Additional conditions and data processing may be displayed separately for some competitions or surveys and may supplement this point.

2. use of your data for advertising purposes

a. Creation of pseudonymized usage profiles

In order to provide you with personalized services and information on our website (on-site targeting), we use and analyze the data we collect about you when you visit the website. Cookies may also be used for the corresponding processing (see section 6 below). The analysis of your user behavior can lead to the creation of a so-called user profile. Usage data is only merged with pseudonymized, but never with non-pseudonymized personal data. We base the creation of pseudonymized user profiles for advertising and analysis purposes on a legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR. This applies to all of the items listed in this section. 2 listed data processing operations. The legitimate interest lies in direct marketing and analyzing the use of our website.

3. disclosure of data to third parties

We only pass on your personal data if you have expressly consented to this, if there is a legal obligation to do so or if this is necessary to enforce our rights, in particular to enforce claims arising from the relationship between you and Bad Zurzach Tourismus.
In addition, we pass on your data to third parties insofar as this is necessary in the context of using the website to provide the services you have requested and to analyze your user behavior. If this is necessary for the purposes mentioned in sentence 1, the data may also be transferred abroad. If the website contains links to third-party websites, Bad Zurzach Tourism no longer has any influence on the collection, processing, storage or use of personal data by the third party after clicking on these links and accepts no responsibility for this.

4. transfer of personal data abroad

Bad Zurzach Tourism is also entitled to transfer your personal data to third-party companies (contracted service providers) abroad if this is necessary for the data processing described in this privacy policy. They are obliged to protect data to the same extent as we are. If the level of data protection in a country does not correspond to that in Switzerland or the EU, we contractually ensure that the protection of your personal data corresponds to that in Switzerland or the EU at all times.

5. data security

We use suitable technical and organizational security measures to protect your personal data stored by us against manipulation, partial or complete loss and against unauthorized access by third parties. Our security measures are continuously improved in line with technological developments.
You should always keep your payment information confidential and close the browser window when you have finished communicating with us, especially if you share the computer with others.
We also take data protection within the company very seriously. Our employees and the service companies commissioned by us have been obliged by us to maintain confidentiality and to comply with data protection regulations.

6. cookies

Cookies help in many ways to make your visit to our website easier, more pleasant and more meaningful. Cookies are information files that your web browser automatically stores on your computer’s hard disk when you visit our website. Cookies neither damage the hard disk of your computer nor do they transmit personal user data to us.
We use cookies, for example, to better tailor the information, offers and advertising displayed to you to your individual interests. The use does not result in us receiving any new personal data about you as an online visitor. Most Internet browsers accept cookies automatically. However, you can configure your browser so that no cookies are stored on your computer or so that a message always appears when you receive a new cookie. If you deactivate cookies, you may not be able to use all the functions of our website.

7. tracking tools

We use various tracking tools on our website. These tracking tools are used to monitor your surfing behavior on our website. This monitoring is carried out for the purpose of the needs-based design and continuous optimization of our website. In this context, pseudonymized user profiles are created and small text files stored on your computer (“cookies”) are used.
Further information on the tracking tools used and the resulting data processing can be found here. (Link to: https://www.myswitzerland.com/de-ch/tracking-tools.html)

8. google analytics

Google Analytics is a service provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. We use Google Analytics on our website to create anonymized analyses of website usage. For this purpose, a cookie is set and the log data of the session is sent to Google.

9. social media plug-ins

The social plugins described below are used on the website. The plugins are deactivated on our website by default and therefore do not send any data. You can activate the plugins by clicking on the corresponding social media button. If these plugins are activated, your browser establishes a direct connection with the servers of the respective social network as soon as you visit one of our websites. The content of the plugin is transmitted by the social network directly to your browser, which integrates it into the website. The plugins can be deactivated again with one click. Further information can be found in the respective privacy policies of Facebook, Twitter and Google.

a. Social plugins from Facebook

Social plugins from Facebook are used on this website to make our web presence more personal. We use the “LIKE” or “SHARE” button for this purpose. This is an offer from the US company Facebook Inc, 1601 S. California Ave, Palo Alto, CA 94304, USA.
By integrating the plugins, Facebook receives the information that your browser has accessed the corresponding page of our website, even if you do not have a Facebook account or are not currently logged in to Facebook. This information (including your IP address) is transmitted directly from your browser to a Facebook server in the USA and stored there.
If you are logged in to Facebook, Facebook can assign your visit to our website directly to your Facebook account. If you interact with the plugins, for example by clicking the “LIKE” or “SHARE” button, the corresponding information is also transmitted directly to a Facebook server and stored there. The information is also published on Facebook and displayed to your Facebook friends.
Facebook may use this information for the purposes of advertising, market research and the needs-based design of Facebook pages. For this purpose, Facebook creates usage, interest and relationship profiles, e.g. to evaluate your use of our website with regard to the advertisements displayed to you on Facebook, to inform other Facebook users about your activities on our website and to provide other services associated with the use of Facebook.
If you do not want Facebook to assign the data collected via our website to your Facebook account, you must log out of Facebook before visiting our website.
The purpose and scope of the data collection and the further processing and use of the data by Facebook as well as your rights in this regard and setting options to protect your privacy can be found in Facebook’s data protection information.

b. Social plugins from Twitter

Plugins of the short message network Twitter Inc, 795 Folsom St., Suite 600, San Francisco, CA 94107, USA are integrated on our website. You can recognize the Twitter plugins (tweet button) by the Twitter logo on our site. You can find an overview of the tweet button here here (link https://developer.twitter.com/). If you have activated social plugins, a direct connection is established between your browser and the Twitter server. Twitter receives the information that you have visited our site with your IP address. If you click on the Twitter “tweet button” while you are logged into your Twitter account, you can link the content of our pages to your Twitter profile. This allows Twitter to associate your visit to our pages with your user account. We would like to point out that, as the provider of the pages, we have no knowledge of the content of the transmitted data or its use by Twitter. Further information on this can be found in Twitter’s privacy policy.
If you do not want Twitter to be able to assign your visit to our pages, please log out of your Twitter user account.

c. Social plugins from Instagram

Functions of the Instagram service are integrated on our pages. These functions are offered by Instagram Inc, 1601 Willow Road, Menlo Park, CA, 94025, USA. If you are logged into your Instagram account, you can link the content of our pages to your Instagram profile by clicking on the Instagram button. This allows Instagram to associate your visit to our pages with your user account. We would like to point out that, as the provider of the pages, we have no knowledge of the content of the transmitted data or its use by Instagram. Further information on this can be found in Instagram’s privacy policy. (instagram.com/about/legal/privacy/)

10. evaluation of newsletter usage

We use third-party email marketing services to send our newsletter. Our newsletter may therefore contain a so-called web beacon (tracking pixel) or similar technical means. A web beacon is a 1×1 pixel, invisible graphic that is associated with the user ID of the respective newsletter subscriber.

The use of corresponding services makes it possible to evaluate whether the e-mails containing our newsletter have been opened. It can also be used to record and evaluate the click behavior of newsletter recipients. We use this data for statistical purposes and to optimize the content and structure of the newsletter. This enables us to better tailor the information and offers in our newsletter to the individual interests of the respective recipient. The tracking pixel is deleted when you delete the newsletter.

To prevent tracking pixels in our newsletter, please set your mail program so that no HTML is displayed in messages.

11. note on data transfers to the USA

For the sake of completeness, we would like to point out to users resident or domiciled in Switzerland that there are surveillance measures by US authorities in the USA that generally allow the storage of all personal data of all persons whose data has been transferred from Switzerland to the USA. This is done without differentiation, limitation or exception on the basis of the objective pursued and without an objective criterion that makes it possible to limit the access of the US authorities to the data and their subsequent use to very specific, strictly limited purposes that can justify the interference associated with both access to these data and their use. We would also like to point out that there are no legal remedies available in the USA for data subjects from Switzerland that would allow them to gain access to the data concerning them and to obtain its correction or deletion, or that there is no effective legal protection against general access rights of US authorities. We explicitly inform the data subject of this legal and factual situation so that they can make an appropriately informed decision to consent to the use of their data.
We would like to point out to users residing in an EU member state that the USA does not have an adequate level of data protection from the point of view of the European Union – partly due to the issues mentioned in this section. Insofar as we have explained in this privacy policy that recipients of data (such as Google, Facebook and Twitter) are based in the USA, we will ensure that your data is protected at an appropriate level by our partners either through contractual arrangements with these companies or by ensuring that these companies are certified under the EU-US Privacy Shield.

12. right of access, rectification, erasure and restriction of processing; right to data portability

You have the right to receive information about the personal data that we store about you free of charge upon request. In addition, you have the right to have incorrect data corrected and the right to have your personal data deleted, provided that this does not conflict with any legal obligation to retain data or an authorization that allows us to process the data. In accordance with Articles 18 and 21 GDPR, you also have the right to request the restriction of data processing and to object to data processing.
You also have the right to request that we return the data that you have provided to us (right to data portability). On request, we will also pass the data on to a third party of your choice. You have the right to receive the data in a common file format.
You can contact us for the aforementioned purposes via the e-mail address welcome@badzurzach.info. We may, at our discretion, require proof of identity in order to process your application.
You can also tell us what you want to happen to your data after your death by giving us appropriate instructions.

13. storage of data

We only store personal data for as long as is necessary,

  • to use the above-mentioned tracking, advertising and analysis services within the scope of our legitimate interest;
  • to provide services to the extent specified above that you have requested or for which you have given your consent (e.g. for newsletters in accordance with Section 9);
  • to comply with our legal obligations.

Contract data is stored by us for longer as this is required by statutory retention obligations. Retention obligations that oblige us to retain data arise from accounting and tax regulations. According to these regulations, business communications, concluded contracts and accounting documents must be stored for up to 10 years or up to 5 years for users resident in France. If we no longer need this data to perform the services for you, the data will be blocked. This means that the data may then only be used for accounting and tax purposes.

14. right to lodge a complaint with a data protection supervisory authority

If you are resident in an EU country, you have the right to lodge a complaint with a data protection supervisory authority at any time.
